Terms of Service

These Terms of Service ("Terms") govern your use of https://centralnjbasementremodel.com (the "Site") and any request you submit through it. "Central NJ Basement Remodel," "we," and "us" refer to the operator of the Site. By using the Site or submitting a request, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.

Section 9 requires most disputes to be resolved by individual arbitration and waives class actions and jury trials. Please read it carefully.

1. Referral Service Only

Central NJ Basement Remodel is a free referral service. When you submit a request, we may share it with an independent local contractor who may contact you about your project. We are not a contractor. We do not perform, supervise, inspect, or guarantee any work, and we do not provide estimates, designs, permits, materials, or labor. We are not a party to any agreement between you and a contractor, and we are not an agent, employee, or representative of any contractor.

Content on the Site, including cost ranges, guides, and FAQs, is general educational information. It is not professional, engineering, legal, or financial advice, and it may not reflect the conditions of your home or current local requirements.

2. No Endorsement or Warranty of Contractors

Contractors are independent businesses. A referral is not an endorsement, recommendation, or representation about any contractor's qualifications, registration, licensing, insurance, workmanship, pricing, reliability, or availability. We do not check or confirm any of these things, and we make no promise that a contractor will contact you, provide a quote, or complete a project.

You are responsible for doing your own due diligence before hiring anyone, including confirming the contractor's New Jersey Home Improvement Contractor registration with the Division of Consumer Affairs, asking for proof of insurance, checking references, getting a written contract, and confirming that required permits are obtained.

THE SITE AND THE REFERRAL SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

3. Assumption of Risk

Home improvement work carries risks, including property damage, personal injury, cost overruns, delays, and disputes. You choose whether to hire a contractor and on what terms. You assume all risk arising from your dealings with any contractor you are referred to, including any work performed, payments made, and access you give to your home.

4. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CENTRAL NJ BASEMENT REMODEL IS NOT LIABLE FOR ANY ACT, OMISSION, WORK, PRODUCT, OR STATEMENT OF ANY CONTRACTOR, OR FOR ANY LOSS OR DAMAGE ARISING FROM WORK PERFORMED OR NOT PERFORMED BY A CONTRACTOR. WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS, OR PROPERTY DAMAGE, ARISING FROM YOUR USE OF THE SITE OR THE REFERRAL SERVICE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SITE OR THE REFERRAL SERVICE IS LIMITED TO ONE HUNDRED U.S. DOLLARS ($100).

5. User Indemnification

You agree to indemnify, defend, and hold harmless Central NJ Basement Remodel and its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Site, (b) information you submit, including any phone number or other information that is not yours or that you are not authorized to provide, (c) your dealings with any contractor, or (d) your violation of these Terms or the rights of any third party.

6. Release of Claims Against Us for Contractor Disputes

Any dispute about a contractor's work, pricing, contract, warranty, or conduct is solely between you and that contractor. To the fullest extent permitted by law, you release Central NJ Basement Remodel and its owners, employees, and agents from all claims, demands, and damages of every kind, known or unknown, arising out of or connected with any such dispute. This release does not limit any claim you have directly against a contractor.

7. Contractor Fee Disclosure

The referral service is free to homeowners. Central NJ Basement Remodel may receive a fee from contractors for referrals, including a fee based on a percentage of the value of work a contractor is hired to perform. These arrangements may affect which contractor receives your request. Contractors set their own prices, and we do not control what a contractor charges you.

8. Governing Law and Venue

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules, and by the Federal Arbitration Act as to Section 9. For any matter not subject to arbitration, you and we agree to the exclusive jurisdiction of the state courts located in Middlesex County, New Jersey, or the United States District Court for the District of New Jersey.

9. Individual Arbitration and Class Action Waiver

You and Central NJ Basement Remodel agree to resolve any dispute, claim, or controversy arising out of or relating to the Site, the referral service, any communication from us, or these Terms (a "Dispute") by binding individual arbitration rather than in court. By agreeing to arbitration, you and we are each giving up the right to sue in court and to have a judge or jury decide the Dispute.

• Informal resolution first. Before starting arbitration, the party with a Dispute must send a written description of it to the other (to us at privacy@centralnjbasementremodel.com) and allow 30 days to try to resolve it.
• Rules and forum. Arbitration will be administered by the American Arbitration Association under its Consumer Arbitration Rules before a single arbitrator. Unless the parties agree otherwise, it will take place in Middlesex County, New Jersey, or by video or written submissions.
• Small claims. Either party may bring an individual claim in small claims court instead, if it qualifies.
• Class action waiver. Disputes will be arbitrated or litigated only on an individual basis. You and we waive any right to bring or take part in a class, collective, consolidated, or representative action. The arbitrator may not consolidate claims of more than one person.
• Opt-out. You may opt out of this Section 9 by emailing privacy@centralnjbasementremodel.com within 30 days of first submitting a request, with your name, phone number, and a statement that you opt out of arbitration.
• Severability. If the class action waiver is found unenforceable for a Dispute, this Section 9 does not apply to that Dispute, which will proceed in court under Section 8.

10. Communications

By checking the consent box on our request form, you agree to be contacted as described next to that box. You may opt out of text messages by replying STOP, and of other communications by emailing privacy@centralnjbasementremodel.com. You represent that the phone number you submit is yours or that you are authorized to provide it.

11. Changes and Contact

We may update these Terms by posting a new version on this page with a new effective date. Changes apply to requests submitted after the effective date. Questions about these Terms can be sent to privacy@centralnjbasementremodel.com.
